Terms and Conditions - Video Review

  1. To participate in this competition, the present terms and conditions must be accepted.
  2. The customer will be asked via email a few days after receiving the goods if they want to review the product. The email includes a note that by uploading their own review video, regardless of length, they have the opportunity to enter a competition. There is a surprise package worth 200€ to be won once a month. The draw is random and always takes place in the first week of a month.
  3. The prizes will be drawn among all participants, unless otherwise stated in the procedure description. The recorded time is decisive for the time of participation. Responses received later will not be considered. UAB Makosas is not responsible for delays in data transmission.
    1. If contributions, photos, or videos have been submitted for the purpose of participating in the competition (if advertised as such), by participating in the competition, the participant grants UAB Makosas the unlimited, simple, transferable, free right to use these, in addition to competition purposes, also for editorial or advertising purposes (e.g., in a program trailer on-air or digital on UAB Makosas channels as well as as a post or tweet on their Facebook or Twitter account) and to reproduce, edit, transform, distribute, broadcast, or make the contribution publicly accessible.
    2. The participant undertakes not to upload videos, photos, or texts that infringe third-party copyrights, personal rights, or trademark rights, or that violate competition law or other laws. Furthermore, they are obliged to respect the right to their own image and not to upload photos of people who have not given their explicit consent. The legal responsibility lies solely with the participant.
  5. The winner will usually be notified about the further processing of the competition by sending an email. Occasionally, the prize is sent directly instead of an email notification. For competitions via a social network (e.g., Facebook), the notification is sent via a message to the participant's profile (private message, wall post, or similar notification form). If incorrect data, especially the email address, has been provided in the context of participating in the competition, which prevents UAB Makosas from contacting the winner(s), all claims to the prize will be forfeited, and a new winner will be determined by drawing lots.
  6. Every natural person who has reached the age of 18 and resides in Germany, Austria, or Switzerland is eligible to participate. Minors are excluded from participation.
  7. Each participant is allowed to participate in the competition multiple times.
  8. The winner must report to further processing by sending an email or notification via their profile within three days of the announcement by mail. If this deadline is not met, all claims to the prize will expire, and a new winner will be determined by drawing lots. UAB Makosas reserves the right to extend this deadline at its discretion, depending on the competition, in favor of the winner and to determine a new winner only after a maximum of 14 working days. Prize claims are not transferable. A cash payment of material prizes or similar – for any reason – is excluded. UAB Makosas reserves the right to replace announced material prizes or similar with equivalent alternatives.
  9. Employees, authorized representatives, legal successors, and agents of UAB Makosas, as well as the respective cooperation partner, involved agencies, and their respective relatives of the first and second degree and household members, are not eligible to participate and win.
  10. UAB Makosas reserves the right to exclude persons from the competition in the event of a violation of these terms of participation and in the case of false personal information. UAB Makosas is also entitled to exclude persons from participating in the competition who use unauthorized aids or otherwise gain advantages through manipulation.
  11. UAB Makosas reserves the right to cancel or terminate the competition at any time without prior notice and without stating reasons. UAB Makosas will make use of this possibility in particular if, for technical reasons (e.g., viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons, proper execution of the competition cannot be guaranteed.
  12. The winner or winners are determined by drawing lots unless otherwise described in the procedure. Only one prize is possible per participating person in a competition unless multiple wins are expressly permitted.
  13. The prizes, if they are physical items and UAB Makosas does not expressly declare in the competition explanation that it will not cover the shipping, will be sent by UAB Makosas or the partner by mail, courier, parcel service, or freight forwarder to the postal address provided by the winner. If this is not the case, it is expressly explained in the competition description.
  14. UAB Makosas will be released from all obligations at the latest upon delivery of the prize, unless a previous date is already derived from these terms of participation.
  15. For prizes provided by various partners (prize sponsors/cooperation partners), UAB Makosas is not obliged to provide its own service. The partner is explained in the respective description of the competition. The partner is not a third party within the meaning of these terms of participation. The personal data of the winner(s) will be forwarded to partners for non-commercial purposes so that they can send the prize to the winners.
  16. UAB Makosas is not liable for material and/or legal defects in the prizes sponsored by the partner.
  17. There is no entitlement to a specific travel date for travel winnings. Travel to and from the destination as well as any costs incurred during the trip (minibar, telephone, etc.) are the participant's private costs and are not covered by UAB Makosas. This applies unless otherwise regulated in the sweepstakes details (above).
  18. UAB Makosas is not liable for the insolvency of a partner and any resulting consequences for the online sweepstakes and the payout or delivery of winnings.
  19. UAB Makosas is only liable for damages caused by UAB Makosas or one of its vicarious agents intentionally or through gross negligence or by the breach of cardinal obligations. This does not apply to damages resulting from injury to life, body, and/or health and claims arising from the Product Liability Act.
  20. UAB Makosas collects, processes, and stores only such personal data as is necessary for the execution and handling of the sweepstakes and only for the duration of the sweepstakes. Personal data will not be disclosed to third parties (neither for commercial nor non-commercial purposes unless required for prize processing) and will not be used for any advertising purposes. UAB Makosas ensures that all personal data is treated confidentially in accordance with the applicable German Data Protection Act (BDSG). Further information on data protection can be found at www.UAB Makosas.de/datenschutzbestimmungen. Participation can be revoked during the participation period at kundenservice@komfortkissen.de. The revocation should include the name and the specific sweepstakes.
  21. Legal recourse is excluded.
  22. The law of the Federal Republic of Germany applies.
  23. If any of these terms of participation are or become invalid, the validity of the remaining terms of use shall remain unaffected.
  24. These terms of participation can be changed by UAB Makosas at any time without separate notification.
